Regulations
Clause 18 of the Regulations provides a requirement that, “the lessee and other users of common parts of the building shall take especial care between the hours of 11.00pm and 8.00am to maintain silence and not to cause disturbance or annoyance to other tenants or occupiers of the building.”
Clause 2(e)(xvii) This clause also covers nuisance and is basically a general requirement that no nuisance will be caused to the owner’s or occupiers of any adjoining premises at any time.
Noise from DIY, refurbishment or alterations
If you are planning a long period of refurbishment, it would be polite to let your neighbours know the extent and duration of the noise disturbance so they can plan accordingly. Ensure notices are placed in all blocks on the notice boards.
You must be on site for the duration of any works to ensure your contractors are following the rules with regards to parking, permitted hours of work an in-case of emergencies. If you are not able to be on site, a family member, relative, close friend must be on site. Items for waste/ recycling must not be left anywhere within the grounds of Wilbury Grange without written permission from the managing agent. Ensure your contractors protect the carpets and walls within the communal areas and observe the weight limits of the lifts. Any charges incurred with regards to additional cleaning of the communal areas, lift call out fees due to the lift being overloaded will be charged accordingly.
The Board requests that you restrict noisy DIY or works to within these hours:
- Monday – Friday 8.00am – 6.00pm
- Saturdays 9.00am – 2.00pm
- Sundays & Bank Holidays No works permitted
What to do about noise
We live in close proximity to each other and it is important to realise that noise can affect your neighbours. Basically we need to live together as peacefully as we can. Remember that noise can travel more in the summer when people have doors and windows open and when people are on their balconies. If excessive noise is made at inappropriate times then people need to have a quiet word with their neighbours.
If those responsible for the noise are unwilling to keep quiet, however, the next step is to call in the local authority’s noise control unit. Brighton and Hove’s environmental Health Officers are responsible for investigating noise nuisance.
